Dear Gregg Horton,

This letter shall serve as the City’s formal written response to your request under the California Public Records Act (Government Code section 7920 et seq.).

Under established California Law, the City is obliged to comply with a request for a public record so long as the requestor makes a specific and focused request for information, that information is maintained by the City in its ordinary course of business, the information is disclosable, and the record can be located with reasonable effort. The Public Records Act provides for the inspection or copying of existing identifiable public records; it does not compel the City to create new records, lists, privilege logs or reports in response to a request.

This communication shall serve as the City’s additional formal written response.

The City is required to determine whether the request, in whole or in part, seeks copies of disclosable public records. Consistent with that requirement, the City has conducted a search, and responsive records were found.

You requested records from the Benicia Police Department for the time period beginning January 1, 2023, through December 31, 2025. Please note the information provided is through December 11, 2025. Results are as follows:

Total Incidents/Cases: Any readily available record, report, or statistical summary that indicates the total number of criminal incidents or cases recorded, initiated, or opened by the Benicia Police Department during the specified time period. - In 2023, there were 31,407 incidents and 2,021 cases. In 2024, there were 31, 718 incidents and 1,963 cases. In 2025 (through 12/11/25), there were 32,493 incidents and 1,977 cases.

Flock Camera Usage: Any readily available record, report, or statistical summary that indicates the total number of criminal incidents or cases in which data (hits, images, or investigative leads) obtained from the BPD’s Flock Safety ALPR system was accessed, referenced, or used in the investigation, clearance, or closure of the case during the specified time period. - In 2023, there were 408 incidents and 234 cases in which FLOCK was referenced. In 2024, there were 675 incidents and 226 cases in which FLOCK was referenced. In 2025 (through 12/11/25), there were 878 incidents and 178 cases in which FLOCK was referenced.
