TheCEQANOEwasfiledinMayof2024.WhentheCEQA
NOE is filed it starts a 30 day clock in which the state will review
exemption. When an exemption is accepted the exemption
document is not issued. If an exemption is challenged/not
Initial Study to determine whether an Environmental Impact
Report is required, or whether a Negative Declaration can be
filed instead.
City of Benicia/Benicia PD did not receive a requirement to file,
so the exemption was deemed approved when the clock
expired last year.
Regarding NEPA-the State of Californiais the lead agency for
filing NEPA, so that filing would need to be completed by
Caltrans, or a California State agency operating on behalf of
Caltrans. I’ve only ever seen this done when Caltrans needs
permissionfromFHWAtoissueapermit.I don’tbelieveNEPA
is warranted for BeniciaPD’s project because CA-780 is a state
route,notan interstate.I don’t believe CaltransneedsFHWA
approval to issue a permit for work in Caltrans controlled right of
way, but that determination probably needs to come from
Caltrans.
